Introduction

Hello – and welcome to Pipebudi created by Kopva.

These are the terms and conditions provided by Kopva Ltd (“Kopva”, “Pipebudi”, “we”, “us”) on which we supply products to you, whether these are goods, services or digital content. Please read them as they will tell you everything you need to know about the terms on which we will deal with each other following your purchase.

If you set up a Kopva account or use our products you accept and agree with these terms and conditions. We may update these terms to reflect changes to the services or legal requirements. If changes are material, we will provide notice by posting the updated terms and updating the “last updated” date. Your continued use of the services after changes become effective constitutes acceptance.

You agree to indemnify and hold Kopva harmless from claims, damages, losses and expenses (including reasonable legal fees) arising from your misuse of the services or violation of these terms.

These terms are governed by the laws of the United Kingdom.

You must be at least 18 years old (or the majority in your jurisdiction) to use the services. You are responsible for maintaining the confidentiality of your account and for all activity under it.

The protection of your personal information is important to us. We respect your privacy and want you to understand what we do with the information we hold about you. We recommend that you read our Privacy Notice, which can be found at Kopva.com, to understand how we collect and use your personal data and your data protection rights. Please note that our Privacy Notice does not form part of your contract with us, and that Kopva Limited is the data controller of your personal data.

Information about us and contact details

We, us or our means Kopva Limited (also trading as Pipebudi) Carlton House, Grammar School Street, Bradford, BD1 4NS registered in England and Wales with company number 13051363, VAT No: GB 384327578. Our products and services are only intended for use in the UK.

If you purchased a product from one of our retail partners, Kopva is the supplier of the services, on behalf of that retailer.

We do not offer installation of our products, we recommend you use a fully qualified and registered professional.

Complaints

We take any complaint seriously and we’ll do our best to resolve the issue right away. If we need more time to investigate, we’ll let you know and keep you updated. If you have any comments or complaints, please email us support@kopva.com.

Our contract with you

How we will accept your order

Our acceptance of your order will take place when we send an email to the email address you supply at point of sale. Acceptance will occur when you receive an email confirming your purchase and that we have dispatched the order, at which point a contract will come into existence between you and us.

Delivery of your order

During the sales process we will provide you with an estimated delivery date. We will deliver your order as soon as reasonably possible and in any event within 30 days after the day on which we accept your order. Delivery of an order shall be completed when we deliver the product to the address you supplied us at point of sale, and the product will be your responsibility from that time.

If we cannot accept your order

If we’re unable to accept your order, we’ll contact you to let you know why. This might be because the product is out of stock, because we have identified an error in the price or description of the product or because we’re unable to meet a delivery deadline you have specified. You will receive a full refund.

Your legal rights

Nothing in these terms will affect your legal rights.

Kopva products

Product requirements

All Kopva products require a connection to Wi-Fi to work. To use our products, you’ll need the following in the property where the devices are being installed:

  • a domestic broadband connection with sufficient bandwidth and Wi-Fi.
  • a power socket close to where you will fit the product onto your pipes.
  • an Android or iOS device with an up-to-date operating system with Internet access.
  • an up-to-date web browser to use the online dashboard (Edge, Chrome, Safari or Firefox).

Product changes

Through our continuous improvement programme, we may change our Pipebudi:

  • to reflect changes in relevant laws; and/or
  • to implement minor technical adjustments and improvements.

Pipebudi app

In respect of the Kopva app, the law requires that digital content must be as described, fit for purpose. This means that we will take the necessary steps to resolve any issues that may arise if the digital content is deemed not fit for purpose.

Product guarantee

Kopva guarantees the device against defect in materials and workmanship under normal use for a period of 12 months from the date of purchase against manufacturing defects in materials and workmanship.

Remedies are limited during the guarantee period to repair or replacement at our discretion, subject to the following conditions:

  • the product must have been used for its intended purpose and in accordance with the user manual / installation instructions.
  • proof of purchase (receipt or invoice) must be provided.
  • the guarantee does not cover normal wear and tear, accidental damage, misuse, or any alteration or repair carried out by anyone not authorised by Kopva Limited.

This guarantee is in addition to, and does not affect your statutory rights under UK consumer law.

To make a claim under this guarantee, please contact our support team support@kopva.com. You may be asked to return the product along with proof of purchase and a description of the issue.

Installation

Subject to meeting the installation criteria, Pipebudi aims to detect leaks within the property system and automatically shuts off the valve to limit damage. It does not prevent leaks; it alerts you when a leak is detected through an app notification.

Installation must be completed by a fully qualified and registered professional and comply with the criteria specified below:

  • it must be installed on a compatible isolation valve on the internal mains water supply pipe before the pipe branches off around the property, according to the fitting instructions.
  • the installation guide for positioning must be followed.
  • needs to be installed on a mains water supply pipe where there is no heat source impacting the incoming water temperature and surrounding ambient air temperature. Pipebudi has a freeze protection device that responds to temperature thresholds you configure or accept by default.
  • cannot be installed in environments outside it’s specified operating range or in another building that is different to the main domestic property.
  • must be connected to the Pipebudi App.
  • connectivity and notifications require reliable power, Wi-Fi and internet access.
  • once you have downloaded the Pipebudi App, you will need to allow SMS notifications to inform you of the status of your water supply. We won’t be responsible for any damage to your home, if you do not allow SMS notifications.

Pipebudi Plus

Requirements

To use the Pipebudi Plus subscription, you’ll need:

  • a Pipebudi installed as per the installation guide.
  • an Android or iOS device with an up-to-date operating system, with Internet access, if you want to monitor/or control our products via the App.

Features

Pipebudi Plus makes it easier for you to control and save on your water spend and keep an eye on the efficiency of your home. It is available to anyone, whether a new or existing Kopva customer, and will entitle members to various benefits, such as a savings tracker, personalised tips and efficiency alerts. Please note that any savings targets are based on your previous consumption and home profile and are estimations only. We cannot guarantee the savings that can be achieved, and they are subject to how you use your water in your home and how much you follow our tips and suggestions.

Warranty

This warranty applies to all our products that you own, except any product that we have discontinued. Please note that our products must be working and already paired with your Pipebudi App at the point of taking out Pipebudi Plus to be covered by this warranty.

Limitations

This warranty only applies to products we provide; it doesn’t apply to any other unrelated faults with the installation or with your water system or other appliances, some ancillary items are also not covered these include the leads, plugs and battery supplied with the product.

This warranty is subject to fair use, and we may not be able to repair or replace your products if we suspect any abuse.

Consumer rights

This warranty doesn’t affect your statutory rights under the Consumer Rights Act 2015 and any laws that replace it. If you want independent advice about your rights, you can speak to Citizens Advice or Trading Standards.

Termination

If you cancel your Pipebudi Plus subscription or fail to make payment when due, you will no longer receive the features and benefits of this service.

Payment and Fees

Payment

Prices are shown at checkout and may change without notice. Taxes and shipping are calculated at purchase. You can pay for your products using several online services which may change from time to time. You need to pay for your products at the time you buy them. Upon full payment, we will despatch the products to the address provided.

Subscriptions

After you’ve ordered a subscription to pipebudi Plus, we’ll send you an email confirming your payment arrangement, including how much your monthly payment will be, and the date payment will be taken.

We will take payment for any services monthly in advance and on the date of purchase, even if you have not received or installed your products.

Delivery charges

Any delivery charges will be indicated to you and accepted by you during the check-out process before you confirm your order.

What happens if you don’t make a payment

If your payment fails for any reason, we will contact you and make further attempts to take payment. If we do not receive payment within 28 days of date when the payment was due, we may suspend or cancel your agreement and any service you have will cease.

General terms

Suitable for UK only

Our products and services are only intended for use within the UK and should not be used outside of this area.

English language

Everything we write to you – including terms and conditions – will be in English.

UK law

These terms and conditions are governed by the laws of whichever country your property is in, i.e. England, Wales, Scotland or Northern Ireland.

Who can benefit from these terms and conditions?

Nobody other than you can benefit from, or enforce, these terms and conditions.

Transfer of these terms and conditions

We may transfer our rights and obligations under these terms to another organisation. We will contact you to let you know if we plan to do this. If you are unhappy with the transfer, you may contact us to end your contract.

Provided by your Insurance Company

If you received your Pipebudi from your insurance provider or water company, you must only install it at the property which is insured with that insurance provider and for which your water bill with that water company is connected. If you move to a new house and stay with the insurance provider or water company through whom you obtained the Pipebudi you:

  • may install it in your new home in accordance with the Installation Criteria set out above; and
  • should inform us of the change of address by contacting us at support@kopva.com.

Unenforceable terms

If any section of these terms is found to be void or unenforceable by a court, only that section will be removed, and the rest of these terms shall continue to apply as if that section were not included.

Delay in enforcing these terms and conditions

If we delay in taking steps against you in respect of any breach of these terms and conditions, that will not prevent us taking steps against you later. For example, if you miss a payment and we do not chase you, but we continue to provide the products, we can still require you to make the payment later.

Upgrades and updates to digital content

You agree that we may update the software or firmware in your products without telling you first. We may also update the Pipebudi app, and we may require you to install an updated version of it. Any updates will be aimed at improving the performance of the products and the app, but we’ll make sure they continue to match the description we provided before you bought them. We won’t be responsible if an upgrade affects how your products work if this is caused by your own equipment – such as your smartphone or broadband – not supporting the upgrade.

Interference with products and services

You must not reverse engineer, decompile, adapt or alter the object code used to provide the services or any Kopva product itself, unless expressly permitted by law.

Moving home

If you decide to leave your products behind when you move home, then a factory reset may be performed on your device and it may be transferred to a new user.

If you decide to bring your products with you, you will need to use a fully qualified and registered professional to uninstall and reinstall in your new property.

Products and packaging may vary

The images of the products on our website and packaging are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a product’s display of the colours accurately reflects their colour. Your product may vary slightly from those images.

Our responsibility for loss or damage

Foreseeable loss or damage caused by us

We are responsible for any loss or damage you suffer that is a foreseeable result of our failing to comply with these terms and conditions or to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious that it will happen or if both you and we knew it might happen at the time that we accept your order.

Unlawful exclusions and limitations

We don’t exclude or limit our liability where it would be unlawful to do so. This includes liability for:

  • death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors.
  • fraud or fraudulent misrepresentation.
  • breach of your legal rights in relation to the products as summarised above on the first and second pages of these terms and conditions.
  • defective products under the Consumer Protection Act 1987.

Limitation of Liability

To the extent permitted by law, Kopva will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data or goodwill. Our aggregate liability arising out of or relating to the services will not exceed the amount you paid for the device giving rise to the claim.

Damage caused by digital content

If defective digital content which we have supplied, such as the Pipebudi app, can be proven to have damaged any of your devices or digital content and this is caused by our failure to use reasonable care and skill, we’ll take reasonable steps to rectify the situation. However, we won’t be liable for damage which you could have avoided by following our advice to apply an app update offered to you or for damage which was caused by you failing to correctly follow installation instructions or to have in place any advised minimum system requirements.

Unrelated supporting equipment

We won’t be responsible for:

  • the broadband internet connection to your home – if you have any issues with your broadband, you should speak to your broadband provider who will be best placed to help you; or
  • providing a smartphone, computer or internet browser that is compatible with our products and services.

General exclusions

This product is designed to help prevent catastrophic leaks, we do not guarantee that any or indeed all leaks or frozen pipes will be picked up. Please see the section below to find out what we are not responsible for.

We are not responsible for any costs, loss or damage that you or anyone else suffers because of the following:

  • you or anyone else not using any our products or services in line with our instructions, including any user and installation guides.
  • you or anyone else using any of our products or services outside of the UK.
  • problems caused by your or anyone else’s smartphone, computer, internet browser or internet connection.
  • your failure to get the appropriate permission or permissions to install our products in your home.
  • having our products in your home or anyone else’s home without the permission or agreement of any other persons living in that property.
  • you or anyone else exceeding the permitted data limit on your or their broadband or mobile data packages.
  • unauthorised use of your products, for example if your smartphone or log-in details are lost or stolen. We advise you to keep your log-in details safe and to use PIN protection on your smartphone to prevent unauthorised use of your system. If you believe that someone has gained unauthorised access to your system, you can report this to us at support@kopva.com and we will do what we can to help you reset your log-in details.
  • you, or anyone else, hacking into, tampering with, decompiling or reverse-engineering or in any other way interfering with any of our products or altering the radio frequency allocations of your system controls.
  • Circumvented safety features, disrupted services or other users.
  • use or misuse, by you or anyone else, of the data collected by our products or services.
  • our failure to send, or your or anyone else’s failure to receive, a notification to you or anyone else in relation to any of our products or services.
  • your or anyone else’s failure to act because of receiving a notification from our product or service.
  • any costs, loss or damage that you or anyone else suffers because of any of our products or services failing to detect a leak because of a system failure or because the products do not cover the relevant section of your property.
  • any costs, loss or damage that you or anyone else suffers because of any of our products not being properly installed.
  • any costs, loss or damage that you or anyone else suffers because of the records provided by any of our products or services being considered insufficient evidence of adequate security by an insurance company.
  • something outside our reasonable control; or any accidental damage to your products you or someone else has caused.

We cannot guarantee that our products and services will always give you adequate warning or protection, and you understand that they may be interrupted, circumvented, made unavailable or otherwise compromised. The services are provided “as is” or “as available”. We do not guarantee that leaks or frozen pipes will always be detected or prevented. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

You must not and must use every effort to ensure that no other person, decompiles, reverse-engineers, disassembles or otherwise tampers with your product and services.

We are not responsible for any death or personal injury unless it is caused by our own negligence.

These services must only be used in compliance with applicable law.

Routine maintenance

The Pipebudi website, app and services provided by Kopva may be temporarily unavailable if we have to carry out routine or emergency maintenance. We’ll try to inform you in advance, but it may not always be possible to do so. During maintenance, the remote-control function may not be available, but you can still control your water supply by using the manual override.

Consumer rights

Kopva as your processor for personal data

We will collect data that relates to your water use and readings from your Pipebudi from time to time to provide you with an Alert. This will be done in line with our privacy policy which can be found on our website.

Cancellations and Refunds

Your right to end the Contract

You are entitled to cancel this agreement 14 days after the day you purchased your product.

If you bought from us directly

Cooling off period

If you change your mind or decide for any reason that you do not want to keep your product, you can notify us of your decision to cancel the contract and receive your refund. The easiest way to do this is to send an email to support@kopva.com. If you have already received your product, return it in its original packaging and condition within 30 days. If you have installed the product, we will not be able to process your return.

Faulty or mis-described

If your product is damaged or mis-described we will refund you the full price, together with any applicable delivery charges, and any reasonable costs you incur in returning the item to us. Unless the product is faulty or not as described you will be responsible for the cost of returning it to us.

If you bought from a retailer

If you bought your product from one of our retail partners, you should contact the store you purchased it from. Please return your product in its original box and condition along with your proof of purchase to the store that you bought it from. You must return the product in accordance with the retailer’s returns policy.

When we can cancel your agreement

We can cancel your Pipebudi Plus subscription agreement if you don’t make your monthly payments.

If you miss a payment, we’ll contact you to advise you of this and how you can make the missed payment. If your account remains unpaid for more than 24 days, we may suspend or cancel your premium features.

We may write to you to let you know that we are going to stop providing a subscription service. We will let you know at least 30 days in advance of our stopping the service and will refund any sums you have paid in advance for services that will not be provided.

We may suspend or terminate access to the services if you violate these terms or use the services in a way that could cause harm.

You may stop using the services at any time.
